1. Purpose of the Site

The Site provides general information about Lynch’s Metal Fabrication, our capabilities, products, past work, industries served, and custom metal-fabrication services.

The Site also allows visitors to contact us and request project quotes.

Information displayed on the Site is provided for general informational purposes. It does not constitute a binding offer, engineering specification, professional design opinion, or guarantee that we will accept or complete a particular project.

2. Quote Requests and Project Agreements

Submitting a contact form or quote request does not:

  • Create a customer relationship

  • Create a binding contract

  • Guarantee project acceptance

  • Reserve production time

  • Establish final pricing

  • Guarantee a completion or delivery date

Any estimate or preliminary information provided in response to a website submission is subject to review and change.

A project becomes binding only when the parties enter into a separate written quote, proposal, purchase order, service agreement, or other written contract accepted by Lynch’s Metal Fabrication.

The separate written agreement will control matters including:

  • Final specifications

  • Materials and finishes

  • Measurements

  • Drawings and approvals

  • Pricing

  • Deposits and payment terms

  • Production schedules

  • Delivery

  • Installation

  • Changes

  • Warranties

  • Cancellations

  • Returns

  • Ownership of completed work

If these Website Terms conflict with a separately executed written project agreement, the project agreement controls with respect to that project.

3. Product and Project Information

We make reasonable efforts to present accurate information. However:

  • Photographs may show prior or representative work.

  • Materials, finishes, colors, dimensions, and appearance may vary.

  • Custom products may differ from examples displayed on the Site.

  • Availability, pricing, lead times, and delivery options may change.

  • Website descriptions may contain typographical, photographic, or technical errors.

Visitors should contact us to confirm current specifications, availability, pricing, and project requirements.

Nothing displayed on the Site guarantees that a particular product, design, material, finish, service, or production timeline is available.

4. Drawings, Measurements, and Specifications

You are responsible for providing accurate information, measurements, specifications, drawings, quantities, site conditions, and other project requirements.

Unless otherwise stated in a written agreement, information submitted through the Site has not been independently verified by Lynch’s Metal Fabrication.

Final dimensions, materials, finishes, structural requirements, building-code requirements, installation conditions, and other technical details must be confirmed through the applicable written project agreement and approval process.

5. Uploaded Content and Project Materials

The Site may allow you to upload or submit logos, names, photographs, drawings, plans, artwork, specifications, or other materials.

You retain any ownership rights you have in your submitted materials.

By submitting materials, you grant Lynch’s Metal Fabrication a limited, nonexclusive right to review, store, reproduce, and use those materials as reasonably necessary to:

  • Evaluate your request

  • Communicate with you

  • Prepare an estimate, rendering, drawing, or proposal

  • Perform requested services if you engage us

  • Maintain reasonable project and business records

You represent that:

  • You own the submitted materials or have permission to use them.

  • Our use of the materials for your requested project will not violate another person’s intellectual-property, privacy, or contractual rights.

  • The materials do not contain malicious software, unlawful content, or confidential information you are not authorized to disclose.

You are responsible for claims arising from materials you submit without proper authorization.

6. Intellectual Property

Unless otherwise stated, the Site and its content are owned by or licensed to Lynch’s Metal Fabrication.

Protected content may include:

  • Text

  • Photographs

  • Graphics

  • Logos

  • Videos

  • Product descriptions

  • Page layouts

  • Website design

  • Renderings

  • Drawings

  • Software and code

  • Trademarks and service marks

You may view and print reasonable portions of the Site for personal or internal business evaluation.

This disclaimer applies only to the Site. Warranties applicable to an accepted fabrication project, if any, will be stated in the separate written agreement for that project.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Lynch’s Metal Fabrication and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to:

  • Access to or use of the Site

  • Inability to access the Site

  • Reliance on website content

  • Errors or omissions

  • Third-party links or services

  • Unauthorized access to website communications

  • Loss of data, revenue, profits, opportunities, or business

This limitation does not exclude liability that cannot legally be excluded or limited.

Limitations applicable to a fabrication project will be governed by the separate written agreement for that project.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Lynch’s Metal Fabrication and its owners, officers, employees, contractors, and agents from claims, losses, damages, liabilities, and reasonable expenses arising from:

  • Your misuse of the Site

  • Your violation of these Terms

  • Information or materials you submit

  • Your violation of another person’s intellectual-property, privacy, or legal rights

This provision does not apply to claims caused solely by Lynch’s Metal Fabrication’s unlawful conduct.

13. Privacy

Our collection and use of personal information through the Site are described in our Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference.

14. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.

Any legal proceeding arising from these Terms or the Site must be brought in a court of competent jurisdiction located in Michigan, unless applicable law requires otherwise.

15. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be modified to the minimum extent necessary or severed.

The remaining provisions will continue in full force and effect.

16. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.

17. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and Lynch’s Metal Fabrication regarding use of the Site.

They do not replace or modify a separately executed written agreement concerning an actual fabrication project.

18. Changes to These Terms

We may update these Terms periodically. Updated Terms will be posted on this page with a revised effective date.

Your continued use of the Site after revised Terms are posted constitutes acceptance of the updated Terms.
